Terms of Service

1. Acceptance

By creating a ShipPulse account, embedding our widget on a site you control, or otherwise using the service, you agree to these Terms. If you are using the service on behalf of an organization, you represent that you are authorized to bind that organization. If you do not agree, do not use the service.

2. Service Description

ShipPulse is a hosted feedback, public roadmap, changelog and testimonials product. We may add, change, or remove features at our discretion. Material changes affecting paid plans will be announced in advance via email and the changelog.

3. Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access. One account per organization; sharing a single login across multiple companies is a breach of these Terms.

4. Subscription & Billing

Paid plans are billed monthly or annually in advance, in US dollars (or the equivalent in your local currency where Lemon Squeezy charges locally). Subscriptions renew automatically until you cancel. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing cycle. Within the first 14 days of your first paid charge, contact us for a no-questions refund. Beyond 14 days, refunds are at our discretion and evaluated case by case.

5. Acceptable Use

You agree not to use ShipPulse to: (a) violate any law or third-party right; (b) send spam, harvest emails, or generate fake feedback or fake testimonials; (c) embed the widget on sites that promote hateful, harassing, or sexually exploitative content; (d) attempt to probe, scan, or test the vulnerability of the service without our written consent; (e) reverse-engineer or scrape the product at a rate exceeding documented API limits. We may suspend or terminate accounts that violate these rules.

You also agree not to: (f) use the proof-loop feature to send unsolicited bulk email — the feature is gated to customers who actually voted for the shipped feature, and bypassing that gate (e.g. by uploading a voter list you do not own) is grounds for immediate termination; (g) use the API to mirror our entire dataset for redistribution; (h) circumvent rate limits or other technical controls. Reasonable testing of your own integration is fine and encouraged.

6. Customer Content & Your Customers' Data

You own the content you upload and the data your end-users submit through your widget ("Customer Content"). You grant us a limited license to host, process, and display Customer Content as necessary to operate the service. You are responsible for the legality of Customer Content under the laws applicable to you and your end- users, including obtaining any necessary consent from end-users before submitting their data to ShipPulse. Where GDPR or analogous laws apply to Customer Content, our roles are governed by the Data Processing Addendum at /dpa.

7. Termination

You may terminate at any time from the dashboard. We may terminate or suspend your account for material breach of these Terms, for non-payment after a 14-day grace period, or if continuing to provide the service would expose us to material legal risk. On termination, you may export your data for 90 days, after which we delete it.

8. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability under these Terms is capped at the fees you have paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost revenue, or lost data. The service is provided "as is" without warranties of any kind, express or implied.

9. Governing Law

These Terms are governed by the laws of Cyprus, without regard to conflict-of-laws principles. Disputes are subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus. (This default will be re-evaluated at incorporation; the version reviewed by counsel before enterprise sign-ups may select a different forum.)

10. DMCA

If you believe content hosted via ShipPulse infringes your copyright, send a DMCA notice to [email protected] including: identification of the work, identification of the infringing material with a URL, your contact information, a statement of good-faith belief, a statement under penalty of perjury, and a physical or electronic signature. We will respond consistent with applicable copyright law.

11. Changes to Terms

We may update these Terms. Material changes will be announced at least 14 days in advance via email and in-app notice. Continued use after the effective date constitutes acceptance. Non-material updates (clarifications, typo fixes, sub-processor list updates that do not change the categories of data processed) take effect on publication; the page's "Last revised" date will reflect every update. An archive of prior versions is maintained on request.
